Introduction
The new PRC, Land Administration Law (the "Amended Land Law") was promulgated on 29 August 1998 and became effective from 1 January 1999.
To help the implementation of the Amended Land Law, the State Council promulgated the PRC, Land Administration Law Implementing Regulations (the "Implementing Regulations") which became effective from 1 January 1999, the date when the Amended Land Law took effect. At the same time, the implementing regulations of the old Land Law was repealed.
The Implementing Regulations have the same structure as that of the Amended Land Law, and comprise 46 clauses which are divided into 8 parts. As the regulatory framework and the basic principles have been laid down in the Amended Land Law, the Implementing Regulations are only to make more detailed provisions to facilitate the implementation of the Amended Land Law.
