Interpretation on Several Issues Concerning the Application of the Law in Trials of Patent Infringement Disputes
关于审理侵犯专利权纠纷案件应用法律若干问题的解释
The Interpretation gives further insight on the scope of protection of invention and utility model patents and the determination of infringement thereof, determination on an infringement of a design patent, defence on the ground of prior art or prior use, and confirmation of non-infringement.
解释对专利侵权审判中的主要法律适用问题作了更深入的说明, 包括: 发明、实用新型专利权保护范围的确定以及侵权判定原则，外观设计专利侵权判定的原则，现有技术抗辩以及先用权抗辩的适用，确认不侵权诉讼的受理等。

SPC Interpretation [2009] No.21
The Interpretation has been formulated pursuant to such relevant laws such as the PRC Patent Law, the PRC Civil Procedure Law and while taking into account trial realities, in order to correctly try patent infringement disputes.
为正确审理侵犯专利权纠纷案件，根据《中华人民共和国专利法》、《中华人民共和国民事诉讼法》等有关法律规定，结合审判实际，制定本解释。
Article 1: A people’s court shall determine the scope of protection of a patent based on the claim asserted by the rights holder and pursuant to the first paragraph of Article 59 of the Patent Law. If the rights holder wishes to change the claim it is asserting before the conclusion of arguments in the court of first instance, the people’s court shall permit him to do so.
第一条 人民法院应当根据权利人主张的权利要求，依据专利法第五十九条第一款的规定确定专利权的保护范围。权利人在一审法庭辩论终结前变更其主张的权利要求的，人民法院应当准许。
