In response to several practical legal issues encountered by courts in trials arising out of the 2019 novel coronavirus (COVID-19) pandemic, the Supreme People’s Court of China (SPC) has issued the Guiding Opinions on Several Issues Concerning the Lawful and Proper Trial of Civil Cases Involving the Novel Coronavirus Pneumonia Epidemic (2) and (3) (关于依法妥善审理涉新冠肺炎疫情民事案件若干问题的指导意见(二)(三)) on May 15, 2020 and June 8, 2020, respectively (“SPC Guiding Opinions (2)”, “SPC Guiding Opinions (3)”, collectively the “SPC Guiding Opinions”).
Generally, the SPC Guiding Opinions are organized by legal topics. As for the content, SPC Guiding Opinions (2) mainly deal with trials in three legal fields including contracts, finance, and bankruptcy. For their part, SPC Guiding Opinions (3) are more focused on procedural trial issues; they also discuss transport contract cases and maritime and admiralty cases.
