The PRC Invitation and Submission of Bids Law (中华人民共和国招标投标法) (the Bidding Law) has sought to ensure that all contracts for major projects are awarded through a standard system of public tender.
At the time the Bidding Law became effective in January 2000, it was not clear to what extent it would impact foreign-invested projects and investors hoped that the implementing regulations would clarify the position.
The Regulations
Since the Bidding Law's promulgation, the Ministry of Communications (the MOC) has issued more project specific regulations relating to the implementation of that law. We are concerned here with four regulations that govern the bidding process for contracts relating to water transport and highway projects (collectively, the Regulations).1
