Main contents: The Opinion states that Shanghai municipality will reform its administration and examination system and implement a system of information and undertaking starting from April 1 2004. Section Two of the Opinion lists the criteria for implementing the system of information and undertaking:
- the examination and approval only requires a nominal examination and emphasis is put on the post-examination-and-approval regulation;
- the applicant can judge whether the matter being examined complies with or reaches the conditions or standards; and
- personal rights and property rights of citizens as well as public security and interest are not involved.
The system of information and undertaking requires the administrative authority to inform the applicant of information such as the conditions or standards to comply with or reach and the legal liability for false undertakings, and requires the applicant to make undertakings on such matters as the truthfulness of the information provided and the bearing of relevant legal liability for false undertakings (Section Three). The administrative authority shall carry out subsequent supervision and will handle it in accordance with the law if the party concerned does not comply with or reach relevant conditions or standards (Section Four).
