Main contents: Article 34 of the Regulations has been amended to include public interest as a criterion for suspending or terminating the countervailing investigation and not to adopt provisional countervailing measures or impose a provisional countervailing duty. Compliance with the public interest also becomes essential for imposition of a countervailing duty (Article 38). Article 35 has been amended so that after suspension or termination of the countervailing investigation, at the request of the government of the exporting country (region), the Ministry of Commerce shall resume the investigation of the subsidies and injury. Now findings on both the subsidies and injury have to be positive for the price undertaking to continue to be effective (Article 35).
