Two employment specialists offer their insights on issues worth consideration when hiring expatriate staff.

I'm considering expanding my operations in China and would like to transfer several teams of overseas staff there. I would assume there are various employment law issues I'd have to think about. For example, I recently read in the news about possibly being taxed due to the extension of China's social security programme to foreign workers. Or even, I'm not clear as to whether the home country's laws or Chinese laws would apply to their contracts. In general I'm wondering:

How would PRC labour-related laws affect the company and my foreign staff, and what issues do I need to consider?

The domestic perspective

China has its own set of labour laws and regulations that may or may not apply to foreign workers in China depending on several different factors. Below are some of the main issues companies need to consider before sending employees to the PRC.
