Legislation roundup: Establishing securities companies and Shenzhen headquarters

    The CSRC has released draft Rules and trial Provisions governing the establishment of securities companies, while the Shenzhen City Government has issued Measures encouraging enterprises to set up headquarters there

    China Securities Regulatory Commission, Rules for the Establishment of Securities Companies with Foreign Equity Participation (Draft for Comments)

    According to the Draft, the percentage of the shares of or the percentage of the interest in a securities company with foreign equity participation held by foreign investors may not, in aggregate, exceed 49% (including shares/interests held directly or controlled indirectly). The split is now one-third.
