为正确审理独立保函纠纷案件，切实维护当事人的合法权益，服务和保障"一带一路"建设，促进对外开放，根据《中华人民共和国民法通则》《中华人民共和国合同法》《中华人民共和国担保法》《中华人民共和国涉外民事关系法律适用法》《中华人民共和国民事诉讼法》等法律，结合审判实际，制定本规定：
