Beijing IP Court Rules that AI Content is Entitled to Copyright

On Nov. 27, 2023, the Beijing Intellectual Property Court (Beijing IP Court) ruled in favor of a plaintiff, stating that artificial intelligence-generated content (AIGC) is protected by Chinese copyright laws, according to China Daily. This case involved Plaintiff Li accusing Defendant Liu of using his image without his consent, thereby violating copyright infringement. Li filed a lawsuit against Liu, requesting a public apology and compensation of RMB 5,000 from defendant Liu. During the court session, Liu argued that she used the image for non-commercial purposes, intending to only use the image to enhance her post about original poetry. Nevertheless, the Beijing IP Court ruled in favor of Li, stating that defendant Liu should issue a public apology within 24 hours on social media to Li, pay RMB 500 in compensation and RMB 50 for court fees.
