European Court Sets out New Approach on FRAND Proceedings


A Munich regional court has issued written FRAND guidance that casts serious doubt on the utility of interim licence declarations from U.K. courts in standard-essential patents (SEP) disputes. In a sharp rebuke to Samsung’s recent U.K. success, the German court warned that implementers relying on foreign interim licences to pressure SEP holders into agreements could face injunctions.
