New enterprise bankruptcy draft deals with cross-border bankruptcy cases / Issued: 2025-09-22

Main contents: Where the domicile or habitual residence of a debtor is located outside the People’s Republic of China, but jurisdiction by a people’s court would be more favorable to the interests of a creditor, the creditor or the debtor may apply for settlement of the debt in accordance herewith. Jurisdiction over a case as specified in this paragraph shall be exercised by the intermediate people’s court with the closest connection to such case.
Where, following review, it is confirmed that the law of the foreign country does not contain discriminatory provisions, the debtor or creditor in such country
